1. Object

1.1 These General Terms and Conditions, updated May 2024, together with the Order Form and any other documents referred to therein, govern the terms and conditions under which the Online Shop Service is offered by Garrafeira Nacional (Osório Silva e Ribeiro, Lda), with its registered office at Rua de Santa Justa nº18, 1100-485, Lisbon, with company number 500 477 078 and share capital of €300.000,00 hereinafter referred to as Garrafeira Nacional.

1.2 The purchase of any product from Garrafeira Nacional's online shop implies acceptance of these General Terms and Conditions.

1.3 All alcoholic beverages offered for sale in our online shop can only be purchased by persons who are of legal age in their respective countries.

2. Product Information, Prices and Contents

2.1 Garrafeira Nacional reserves the right to modify, without prior notice and at any time, the information and commercial offer on products, prices, sales, commercial conditions and services.

2.2 The images illustrating each product in Garrafeira Nacional may differ from the product delivered; the same products may also be out of stock.

2.3 Despite our best efforts, some of the prices displayed may be inaccurate. For this reason, the company will always check the prices when proceeding to process the order. Therefore, the prices displayed in Garrafeira Nacional are indicative only and do not constitute an offer of contract. If the actual price is lower than the advertised price, Garrafeira Nacional will refund the excess. If the price is higher, the company will inform the customer of this situation by email and will wait for the customer's decision to accept the new price or to cancel the order within 15 days of receiving the email.

2.4 In accordance with Portuguese legislation, all prices displayed in Garrafeira Nacional include the necessary VAT taxes, unless otherwise stated. For resellers only, prices do not include VAT tax, which is clearly indicated next to the price under the reference "Sem IVA" (without VAT).

2.5 Special sales advertised in Garrafeira Nacional may not apply to the physical stores: GN Santa Justa, GN Conceição and GN Mercado da Ribeira.

Order and Payment

3.1 After confirming the order placed in Garrafeira Nacional, an email will be sent to the registered contact person with all the information regarding delivery, invoicing, payment information, products and prices. Garrafeira Nacional recommends the confirmation of all information by the customer. In such cases where the customer does not receive the email confirming the order, it is requested to contact Garrafeira Nacional through one of the following contacts, so that the notification is sent again to the customer's email.

3.2 If any of the information provided by the customer appears incorrect and/or the customer wishes to change the information while the order has not yet been shipped, the customer is requested to contact us via the following options as soon as possible so that the requested change can be made internally.

3.3 All orders placed with Garrafeira Nacional will not be processed until payment has been received. Placing the order in itself does not constitute a product reservation.

3.4 If the order cannot be fulfilled in whole or in part, Garrafeira Nacional will contact the customer immediately in order to find a mutually suitable solution.

3.5 All orders placed with Garrafeira Nacional have a maximum payment period of 24 hours, after which the order will be automatically cancelled.

3.6 Orders can be cancelled if the customer expressly states so through one of the following contacts before the orders are shipped. After shipment, the customer will be asked to contact Garrafeira Nacional, so that together with the customer will try to find a solution suitable for both parties.

3.7 These payments are all accepted in the Garrafeira Nacional Online Store: Multibanco Reference, MBWAY (these two only for customers with a Portuguese bank account), FLOA (this one only for customers resident in Portugal and orders from €50 to €2500), Bank Transfer, Paypal, Google Pay, Apple Pay, Pix and Boleto Bancário (the last two only for customers living in Brazil).

3.8 The order status has these phases: Pending, Processing, Payment review, On Hold, Facturação- Processing, Completed.


a) Pending - Waiting for payment confirmation in Garrafeira Nacional's system;
b) Processing - Payment has been;
c) Payment Review: Payment being analysed, our team will contact you if the need arises;
d) On Hold - Further confirmation is expected from the customer to advance the order status towards completion. This is only in special cases.
e) Facturação-Processing – The order is being processed and packed/prepared;
f) Completed - The order was shipped.

3.9 Payments are accepted in euros. Regardless of which currency the customer uses for his transactions, Garrafeira Nacional will convert them into euros. The conversion fees will be charged to the customer.

3.10 Our customer service may request some documents in certain situations in order to process the order.

3.11 Pay in 3 instalments free of charge by credit or debit card with your partner FLOA BANK, a public limited company (société anonyme) with share capital of €72,297. 200, registered with the Bordeaux commercial register under number 434 130 423, with its registered office at Bâtiment G7 - 71 Rue Lucien Faure in Boreaux (33300), FRANCE, offers payment solutions reserved for individuals (natural persons of legal age) resident in Portugal and holders of a Visa or MasterCard bank card with an expiry date corresponding to the duration of the refund which allows you to pay for your purchases of goods and/or services, via "Payment in 3X", without interest. Once you have completed your order, you must choose to pay using the "Payment in 3X" payment method by Credit or Debit Card; you will then be redirected to the FLOA BANK website, where you can make your payment. FLOA BANK reserves the right to accept or refuse the financing request; the customer may cancel the payment request within 14 days. For more information, click here.
Please note that if you request payment for your order of goods and/or services using these payment methods, your personal data will be passed on to FLOA BANK for the purposes of analysing the financing request, managing the credit agreement and, where appropriate, recovery. 4. Shipping costs

4.1 To the prices presented with the products, there is a corresponding shipping value for each order, calculated with the sum of two factors: Packaging Cost and Shipping Cost. The packaging cost for each bottle is €2 (Euro). The transport cost depends on the weight of the order and the destination. This value can be simulated in the shopping cart by adding the desired product and filling in all the required fields of the simulator. The total amount of shipping costs will be calculated automatically when you place your order in the online store. Please be mindful that some factors of these calculations vary and can be changed without prior notice.

5. Shipping and deliveries/collection from the Garrafeira Nacional shop

5.1 To ship orders to the address provided, please select the option - National Shipping (if you are in Portugal) or International Shipping (if you are in other countries).

5.2 In the available shipping methods, you will find information on the estimated delivery time and relevant comments on the shipping process. It is important to emphasise that these times are estimates only and that any delay in delivery does not constitute a breach of contract or an obligation to compensate the customer.

Generally, once a Garrafeira Nacional order has been dispatched, it takes approx.:

- 72 hours (working days) to mainland Portugal. If it is necessary to bring the stock to the shipping warehouse to complete the order, this period may be longer than 72 hours (working days);
- Approximately 15 working days to Madeira and the Azores islands;
- Between 4 and 7 working days for the Spanish Peninsula;
- Between 6 and 9 working days for other European countries;
- Approximately 15 working days for all other countries.

The delivery times, which are calculated from the date of actual dispatch of the order, are indicative and only apply in the absence of external obstacles such as incorrect addresses or unforeseen events such as strikes, bad weather conditions, etc. In addition, there may be an exceptional increase in the volume of orders, which may affect delivery times.

5.3 Customers have the choice of delivery address (except PO boxes) and must ensure that someone is available to receive the parcel on the day of delivery from 9 am to 7 pm. The parcel will be transported by a courier appointed by the chosen transport service, who will attempt to deliver it to the specified address. The courier may attempt to contact the customer by telephone to resolve any problems with the delivery, but this action is not guaranteed and does not constitute a commitment on the part of the carrier.

It is not possible to agree a specific delivery time, as this depends on the courier's route on the day of delivery, which is determined by the transport service.

5.4 Providing an incorrect or incomplete delivery address may result in the order being returned to Garrafeira Nacional, resulting in additional costs for the customer. It is therefore advisable that the customer always checks that the delivery address provided when registering the order is correct. Once the order has been registered, it is no longer possible to change the delivery address or billing details.

5.5 In the event of an unsuccessful delivery attempt by the transport company due to absence, a new delivery attempt will be made free of charge. After the third delivery attempt, the customer will be charged additional delivery costs.

5.6 Once the orders have been shipped, tracking information will be available in the customer account if you have registered before placing the order. In addition, a notification will be sent by email with information on the link. This email is sent to both registered and unregistered customers. If for any reason the email does not arrive, the customer is requested to contact Garrafeira Nacional through one of the following contacts so that all available information about the shipment of the order can be resent.

5.7 Once notified of the shipment, customers must monitor the status of the order through the link provided so that they are informed of the current status until the time of delivery, as Garrafeira Nacional will not communicate any changes to the shipment status.

5.8 All products delivered by Garrafeira Nacional will be checked upon delivery. If the customer finds any damage, the costumer must immediately return them to the carrier and duly justify the motif of the returned goods on the carrier's transfer form. The costumer must also contact Garrafeira Nacional immediately through one of the following contacts.

5.9 If, after delivery, the customer finds that one of the products is not in order, the Customer is requested to contact Garrafeira Nacional immediately by email to info@garrafeiranacional.com, indicating the order number or the document number received, and attaching images of all the goods received and the incorrectly delivered product, so that an internal investigation can be launched to find a solution as soon as possible.

5.10 Garrafeira Nacional does not accept responsibility for shipments to countries where the import of alcoholic beverages is prohibited by law. It is the customer's responsibility to accept these orders and pay customs duties, if applicable. If the goods are returned, Garrafeira Nacional will only refund the amount due on the goods. In case of doubt, the customer can contact Garrafeira Nacional before placing the order.

6. Applicable Law

6.1 Garrafeira Nacional grants all customers the right to cancel the contract and return the products purchased within a period of 30 (thirty) days, as described in Legislative Decree No. 109-G/2021 and Decree 84/2021 of 10 December 2021.

6.2 For the replacement or refund, the customer is requested to contact Garrafeira Nacional through the email info@garrafeiranacional.com, indicating the order number or the document that was attached to the order, respecting the following conditions:

a) To return the shipment, it must be in perfect condition and, if applicable, with the original packaging, accessories and promotional offers, proof of purchase or invoice will also be required.
b) Defective or faulty goods will be accepted, in which case Garrafeira Nacional will pay the shipping costs for each case in which the customer notifies this situation within 30 (thirty) days of receipt of the products.
c) Once the goods have been received and the conformity of the goods has been confirmed, we will refund the value of the goods using the same payment method with which the customer purchased the goods. Instead, another solution can be discussed and work if both parties reach an agreement.

6.3 Garrafeira Nacional assumes full responsibility for any defects due to the origin or raw material of the product purchased, and if these are confirmed by a specialised Garrafeira Nacional team, the exchange or refund will be made without any cost to the customer.

6.4 Garrafeira Nacional does not accept returns of used goods or in the case of modifications or alterations.

6.5 Garrafeira Nacional does not accept responsibility for defects caused by improper use, negligence, poor storage conditions or force majeure.

7. Applicable Law

7.1 All purchases made on the Garrafeira Nacional website are governed by Portuguese law. Any conflict or disagreement regarding the interpretation of these Terms and Conditions will be submitted to the Portuguese court.

7.2 In the event that the customer is located outside mainland Portugal, Garrafeira Nacional informs that any legal action may be brought exclusively by the Portuguese courts.

7.3 Pursuant to Article 18 of Law No. 144/2015 of 8 September, Garrafeira Nacional informs that the "Centro de Arbitragem de Conflitos de Consumo de Lisboa" (Lisbon Consumer Disputes Arbitration Centre) is available as an alternative dispute resolution (RAL) centre and has the following contact details:
